    As long as your firmware is not 3.1.3, you can jailbreak. Whether you jailbreak is tethered or untethered depends on whether you have the new or old bootrom. If you have 3.1.3, you can only jailbreak if you have backed up some signed files from a previous firmware release.

    Geohot just came out with a untethered 3.1.3 jailbreak, don't know if it was release yet. But I would hold out on upgrading if you have a 3g/3gs. I think the Iphone dev team is just waiting on the Ipad to release a reliable 3.1.3 unlock.
