I think they probably are. I use peerguardian though and have never received a warning from my isp even though I'm mostly on public trackers so far.
More rare the tracker, more safe I imagine
the harder it is to get into a private tracker, the lower risk you have. you are announcing your IP address to the whole world on a public tracker. just my .02¢

Well put it this way,
On public trackers, really the only way to find your IP would be for the government to download the file themselves and have you as a peer; therefore they would also be participating in illegal content.
On private trackers, if the servers were seized, then they would have your IP and everything else logged, but the government would most likley not go through the hassle of cracking down on it because the community is much smaller, therefore it theroretically does not have as big of an impact on piracy.
