If they don't have free leech torrent and if no admin looking users account thoroughly.
Some tracker track what are the torrents users download and was it free leech or not.
Anyway its all depend on tracker and its size(user base). Also I guess, popular tracker's admin don't have time to enforce all these silly rules; and at the same time enforcing all these rules take toll on site's performance as well.
